La trasformazione del GATT in OMC nel 1995 è stata un successo. I membri rispettano le concessioni e gli altri obblighi dell’OMC più di quanto non facessero con il precedente GATT. I membri dell’OMC sono massimizzatori di utilità. I costi di transazione sono stati notevolmente ridotti nei tavoli multilaterali dell’OMC. Tuttavia, l’OMC è poco incline a ricorrere a misure di ritorsione nei confronti dei propri accordi; pertanto, le sanzioni efficaci potrebbero non essere sufficienti a dissuadere i membri dal rispettare le regole multilaterali. La teoria dei giochi nell’OMC consiste nel capire come si comportano i membri in base alle loro scelte egoistiche nell’ambito della loro razionalità limitata. La naturale differenza tra Stati forti e Stati deboli non significa che gli Stati forti prevalgano sempre su quelli più deboli, poiché ogni Stato ha un diverso tipo di rischio: avversione al rischio, neutralità al rischio o propensione al rischio. La teoria delle prospettive spiega come gli Stati modificano il loro tipo di rischio a seconda dei loro interessi. L’OMC deve liberalizzare equamente il commercio tra gli Stati. Le analisi aiutano a riflettere sul potere esecutivo dell’OMC.
