Las llamadas Leyes Nuevas, aparecieron en 1542, y ponían a los indígenas bajo la protección de la Corona. Tras la llegada de los primeros conquistadores a América, la Corona española exigió que se respetasen las llamadas Leyes de Burgos. Estas había sido sancionadas el 27 de diciembre de 1512, y surgieron por la preocupación de la Corona por el constante maltrato a los indígenas. Bartolomé de las Casas levantó un debate en torno al exterminio de los indígenas. Ante tal situación, el Emperador Carlos V convocó a una junta de juristas a fin de resolver la controversia. Dicha junta propugnó las Leyes Nuevas contenidas en este volumen.
