Ce travail tente de déterminer si les lois et pratiques internationales existantes peuvent éclairer et apporter des solutions aux problèmes actuels liés à la cyberguerre. Il se compose de deux parties. La première partie traite des notions et des définitions qui, à ce jour, ne font pas l’objet d’une compréhension uniforme parmi les universitaires et les États. Elle aborde également brièvement les difficultés techniques et d’attribution, dont la résolution améliorerait considérablement la situation en matière de traçage et de suivi des cyberattaques. La deuxième partie traite de questions juridiques spécifiques. Elle examine tout d’abord si les lois internationales actuelles peuvent intégrer la cyberguerre dans leur cadre, puis aborde les questions relatives à la légitime défense contre une cyberattaque et à la combativité. Cette partie traite également des perspectives d’avenir en matière de réglementation de la cyberguerre par le biais d’un traité international sur la cybersécurité.
