A presente obra se insere no campo dos Novos Direitos, apresentando considerações sobre a construção dos novos direitos a partir da análise sociojurídica do Decreto n.º 4.887/2003 e da ADIn n.º 3.239/2004.Considerando que a análise sociojurídica da questão quilombola comporta aporte histórico, objetiva-se discutir a formação do povo afro-brasileiro, a partir da análise dos aspectos sociais, culturais e identitários que revestem a temática, estabelecendo conexões entre o art. 68 do ADCT e os traços da memória coletiva, da identidade e do território, como mecanismos de proteção quilombola. Compreende-se que apesar das tentativas de silenciamento dos afro-brasileiros e quilombolas em diversos cenários da sociedade brasileira, a Constituição Federal de 1988 proporcionou avanços nos campos sociais, principalmente, na promoção de políticas afirmativas para essa minoria. Entende-se que a emergência do reconhecimento étnico e cultural quilombola, é elemento substancial para a construção da identidade, fomentada por meio da garantia dos direitos fundamentais e de ações afirmativas para a população quilombola e afro-brasileira. Destaca-se que a obra foi pensada e escrita com o intuito de desenvolver e expandir o debate sobre a questão quilombola, considerando as bases da colonialidade e da exploração dos africanos, afro-brasileiros e quilombolas, para compreender a dinâmica dos quilombos na atualidade.
